Ian Holmes Not a Wedding Photographer
Terms and Conditions

This agreement is between Ian Holmes and the bride and groom undersigned below (“THE CLIENT”). Ian Holmes and THE CLIENT hereby agree as follows:

I (THE CLIENT) agree that by paying the retainer to Ian Holmes I am entering into the following agreement with Ian Holmes:

Services:
• Ian Holmes shall provide documentary-style coverage of your wedding.

Image Usage Rights:
• Under Copyright LAW Ian Holmes retains copyright of all images. Ian Holmes gives THE CLIENT rights to delivered images for personal usage. Prints, social media, etc. Any commercial usage whatsoever must be agreed in writing by Ian Holmes.
• Ian Holmes has the right to use the images for self-promotion. His portfolio/wedding blogs, photography competitions, etc. Ian Holmes also has the right to share certain images with vendors who worked on the wedding, florist, caterer, wedding planner, etc. Any other commercial usage outside of this needs to be agreed with THE CLIENT in writing.

Payment of balance:
• It is THE CLIENTS responsibility to ensure any outstanding balance is paid within the timeframe as outlined in the invoice. If payment is not received within the agreed timeframe Ian Holmes reserves the right to cancel the wedding coverage and the deposit/retainer will be forfeit.

Cancelation:
• In the event that THE CLIENT cancels the contracted services for photography outlined in this contract before the wedding ceremony takes place, the deposit/retainer will be forfeit. If the event is canceled within 30 days full payment will be due, and within 90 days 50% of the total package fee will be charged.
• In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer.  Ian Holmes will make every effort to secure a replacement photographer able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.

Travel & Accommodation:
• If travel arrangements are disrupted due to circumstances beyond the control of Ian Holmes ((breakdowns, strikes, canceled flights, accident, etc) which results in the late arrival or cancelation of contracted services for photography responsibility and liability are limited to the return of all payments received for the event package minus the retainer and travel expenses.
• If any of the points outlined above occur Ian Holmes will make every effort to make alternative travel plans to avoid missing coverage. In this case, all additional travel or accommodation expenses incurred are the responsibility of THE CLIENT.

Additional Expenses:
• Any additional expenses not paid for in advance (hotel fees, taxi, meals, etc) must be paid for in full before delivery of the images. For all additional expenses to be valid Ian Holmes must produce receipts.

Non-Guarantee:
• Although every possible care will be taken to produce photographs of all important and special events during the wedding, Ian Holmes cannot place an unconditional guarantee on the above. Ian Holmes will not be held responsible for any ruined photographs due to guests (or any other) flashes; or any other ruined photographs due to any other cause in or outside of Ian Holmes control.

Image Delivery & Archiving:
• Ian Holmes takes the utmost care concerning the transportation and processing of photographs; including using professional-grade equipment and professional-grade backup equipment. However, in the unlikely event of THE CLIENT’S photographs being lost, stolen, or destroyed for reasons within or beyond Ian Holmes control, the latter’s liability is limited to the return of all payments received for the event package.
• Ian Holmes will try whenever possible to deliver images within 6 weeks of your event. In the case of an unforeseen event/emergency, Ian Holmes has the right to extend this time.
• Once the transfer of hi-res images is complete Ian Holmes is not responsible for archiving the images. Ian Holmes will keep all images online for one year after the event.

Risks & Injuries:
• Ian Holmes is in no way responsible for any accidents or injuries that occur during the wedding day. Any risks taken for any particular type of photograph are solely the responsibility of THE CLIENT.

Meals:
• For full days wedding coverage a meal will be provided for both Ian Holmes and (if applicable) the second photographer/assistant.
